Membership Regulation of Luxtreme Adventure Club
1. General Provisions
1.1 The Luxtreme Adventure Club (hereinafter referred to as “the Club”) is a private non-profit organization whose primary objective is to organize trips on an occasional, not-for-profit basis for a limited group of travelers for its members.
1.2 As a non-profit organization, we offer unique expeditions at more accessible prices compared to traditional travel agencies. However, due to our status and the nature of our operations, we do not provide package travel services and, therefore, cannot offer guarantees for reimbursement or repatriation in the event of insolvency. Additionally, we organize trips on an occasional, not-for-profit basis for a limited group of travelers, which exempts us from requiring a commercial travel business permit.
1.3 By becoming a member of the Club, individuals agree to comply with this regulation, the Club’s Articles of Association, and all guidelines for specific events or trips.
2. Membership Rules
2.1 Membership Categories:
- Full Members: Individuals who pay the annual membership fee and participate in activities. They are entitled to vote at the General Assembly and have full access to the Club’s events and services.
- Honorary Members: Individuals or entities who express their support for the Club’s objectives without voting rights or the obligation to pay a membership fee.
2.2 Eligibility:
- Membership is open to individuals aged 18 or above who support the objectives of the Club.
- Membership is personal and non-transferable.
2.3 Application Process:
- Prospective members must complete the online registration form and pay the annual membership fee.
- The Board of Directors reserves the right to approve or reject membership applications without justification.
2.4 Membership Termination:
- Members may resign at any time by notifying the Board in writing. Membership benefits cease immediately upon resignation.
- Members who fail to pay the annual membership fee within two weeks of the due date will be automatically removed from the Club.
- The Board of Directors has the right to expel any member whose actions are harmful to the Club’s interests or who fails to comply with these regulations.
2.5 Photos from Club Activities
As a participant in Luxtreme Adventure Club trips or activities, and as a club member:
- You acknowledge that photos or videos may be taken during events for documentation and promotional purposes.
- By participating in these activities, you agree that the club may use these photos or videos for:
- Posting on the official website (https://luxtreme.lu).
- Sharing on social media platforms such as Instagram, Facebook, and other similar channels.
If you have concerns about a specific photo or video, or if you do not wish to appear in media content, please notify us before or during the event. Requests for removal of media from our platforms can be made via email at [Insert Contact Email].
3. Payments and Membership Fees
3.1 Annual Membership Fee:
- The annual membership fee for Full Members is €30, payable upon registration and annually on the renewal date.
- The membership fee is subject to review and adjustment by the Board of Directors.
3.2 Event and Trip Fees:
- The Club may organize trips and events that require additional fees. These fees will be listed on the event or trip registration page.
- Full payment for participation in events or trips must be made before the specified deadline. Reservations will not be confirmed until payment is received.
4. Refund Policy
4.1 Membership Fees:
- Membership fees are non-refundable once a member has been accepted by the Board of Directors.
4.2 Event and Trip Cancellations:
- Cancellations by the Club: In the event that the Club cancels a trip or event, members will be refunded 80% of the fees paid. The remaining 20% will cover administrative and organizational expenses.
- Refunds will be processed within 30 days of the cancellation notice.
- No refunds will be issued if the event or trip is canceled due to force majeure (natural disasters, pandemics, or other events beyond the Club’s control).
4.3 Member Cancellations:
- No refunds will be given for cancellations initiated by members. Members are advised to obtain appropriate travel insurance to cover any personal cancellations.
5. Travel Insurance and Health Precautions
5.1 Insurance Requirement:
- Members participating in the Club’s trips or events must arrange their own travel insurance. This insurance should cover, at a minimum, medical expenses, repatriation, trip cancellation, and accidents.
- The Club is not responsible for any insurance coverage. Members are advised to check the terms of any travel insurance provided by their credit cards, particularly those issued by Luxembourgish banks, as travel insurance may be included.
5.2 Health Requirements and Vaccinations:
- Members are responsible for ensuring they have received all necessary vaccinations and medical checks required for the destination(s) of the trip. The Club is not liable for health-related issues arising from a failure to comply with medical advice or requirements.
- The Club may provide general information on health risks or recommendations, but it is the responsibility of each member to ensure compliance with the health requirements of the destination country.
6. Visa and Travel Arrangements
6.1 Visa and Entry Permits:
- Members are fully responsible for obtaining all necessary visas and entry permits for the countries visited during trips. The Club may provide assistance by offering general guidance and advice, but the ultimate responsibility for securing appropriate documentation lies with the member.
- Failure to obtain the correct visa or permit will not entitle the member to any refund of fees paid for the trip.
6.2 Flights and Transportation:
- Members are responsible for purchasing their own flight tickets and any other necessary transportation to reach the starting point (meeting location) of the trip or event. The Club may recommend an itinerary, but it is the responsibility of each member to book and arrive at the designated meeting point on time.
- The Club is not responsible for delays or cancellations of flights or transportation. Members must ensure their travel arrangements allow them to arrive at the meeting point on the day and hour specified in the trip description.
7. Code of Conduct for Trips and Events
7.1 Behavioral Standards:
- Members are expected to behave respectfully and responsibly during all Club events and trips. Disrespectful or disruptive behavior, including excessive alcohol consumption or the use of illegal substances, is strictly prohibited.
- Any member violating these behavioral standards may be expelled from the event and, if necessary, from the Club without a refund.
7.2 Compliance with Safety Guidelines:
- Members must follow all safety guidelines provided by the Club and its third-party service providers during events and trips.
- Failure to adhere to safety protocols may result in the member being excluded from further participation in the event.
7.3 Responsibility for Personal Items:
- The Club is not liable for lost, stolen, or damaged personal items during trips or events. Members are responsible for securing their belongings.
8. Waiver of Liability and Disclaimer
8.1 Member Responsibility:
- Participation in any trip or event organized by the Club is at the member’s own risk. The Club, its organizers, and volunteers are not liable for any accidents, injuries, or illnesses that may occur during trips or events.
- Members are fully responsible for ensuring that they are physically capable of participating in the activities organized by the Club.
8.2 Third-Party Service Providers:
- The Club may engage third-party service providers (e.g., travel agencies, accommodation providers, guides) to deliver services during events or trips. While the Club makes every effort to select reputable providers, it cannot be held responsible for the actions, negligence, or failures of these third parties.
- Any legal claims arising from incidents occurring during third-party services must be directed at the third-party provider and not at the Club.
8.3 Indemnification:
- Members agree to indemnify and hold harmless the Club, its Board of Directors, volunteers, and organizers from any claims, liabilities, or damages arising from participation in Club activities.
8.4 Force Majeure:
- The Club shall not be held liable for cancellations or disruptions due to circumstances beyond its control (force majeure), including but not limited to natural disasters, pandemics, or government restrictions.
